Cambodia’s repeated violations of the Joint Declaration
on the outcomes of the meeting between Thailand and Cambodia

1. On 10 November 2025, Cambodia violated the Joint Declaration on the outcomes of the meeting between Thailand and Cambodia, which was signed on 26 October 2025 in Kuala Lumpur, Malaysia, by covertly laying new anti-personnel landmines within Thai territory in Huai Thamariya area, Kantharalak District, Si Sa Ket province. This incident resulted in one of the injured Thai soldiers being permanently disabled.

2. It is deeply regrettable that only two days after, the Cambodian side violated the Joint Declaration again. Cambodia opened fire into Thai territory in Ban Nong Ya Kaew, Khok Sung district, Sa Kaeo province, on 12 November 2025, to provoke a response by Thai military personnel who were compelled to take action to safeguard Thailand’s sovereignty and in self-defense, actions which were conducted in accordance with international law and the Rules of Engagement.

3. Thailand condemns the aforementioned incidents both initiated by the Cambodian side which clearly violate the Joint Declaration. The planting of landmines constitutes a breach of the obligations under the Anti-Personnel Mine Ban Convention (Ottawa Convention) to which Cambodia is a State Party. Thailand has sent a protest letter through Japan in its capacity as President of the Meeting of States Parties to the Convention, also requesting that the letter be circulated to all States Parties. Thailand is also sending a letter to the Secretary-General of the United Nations regarding this matter. Furthermore, during the armed clash at Ban Nong Ya Kaew, Cambodian forces initiated gunfire into Thai territory, which amounts to violation of Thailand’s sovereignty and territorial integrity.

4. Thailand’s actions are undertaken with transparency and fully adhere to international law and standards. To this end, Thailand has invited the ASEAN Observer Team (AOT) to inspect the area where both incidents took place. Thailand also reaffirms its commitment to implementing the Joint Declaration – a crucial milestone in reducing tensions and paving the way towards peace, which both sides have committed to achieve. However, Cambodia has repeatedly violated the Joint Declaration and sought to stage incidents and fabricate false information. Such actions reflect Cambodia’s lack of sincerity in pursuing peace.

5. Thailand wishes to express its sympathy to the families of those affected by the two incidents. In this regard, Thailand calls upon Cambodia to take responsibility, conduct a transparent investigation into the incidents, cease provocative actions, and return to the path of peace in order to reduce tensions and prevent future losses.

กัมพูชาละเมิดซ้ำต่อการปฏิบัติตามถ้อยแถลงผลการพบหารือ
ระหว่างนายกรัฐมนตรีของไทยกับกัมพูชา (Joint Declaration)

1. เมื่อวันที่ 10 พฤศจิกายน 2568 กัมพูชาได้ละเมิดการปฏิบัติตามถ้อยแถลง (Joint declaration) ระหว่างไทยกับกัมพูชา ซึ่งลงนามเมื่อวันที่ 26 ตุลาคม 2568 ที่กรุงกัวลาลัมเปอร์ มาเลเซีย ด้วยการลอบเข้ามาวางทุ่นระเบิดสังหารบุคคลใหม่ในเขตแดนไทยที่ห้วยตามาเรีย อำเภอกันทรลักษ์ จังหวัดศรีสะเกษ จนเป็นเหตุให้หนึ่งในผู้ได้รับบาดเจ็บทุพพลภาพถาวร

2. เป็นที่น่าผิดหวังอย่างยิ่งที่ในเวลาเพียงสองวันต่อมา ฝ่ายกัมพูชาได้ละเมิด Joint Declaration อีกครั้ง ด้วยการสร้างสถานการณ์ยั่วยุ โดยยิงปืนเข้ามาฝั่งไทยบริเวณชายแดนบ้านหนองหญ้าแก้ว อำเภอโคกสูง จังหวัดสระแก้ว เมื่อวันที่ 12 พฤศจิกายน 2568 ทำให้ทหารไทยต้องดำเนินการตอบโต้ เพื่อปกป้องอธิปไตยและป้องกันตนเอง ซึ่งเป็นไปตามกฎการใช้กำลังและหลักกฎหมายระหว่างประเทศ

3. ประเทศไทยขอประณามเหตุการณ์ทั้งสองเหตุการณ์ข้างต้น ซึ่งนอกจากจะเป็นการละเมิด Joint Declaration แล้ว การลอบวางทุ่นระเบิดเป็นการละเมิดพันธกรณีตามอนุสัญญาห้ามทุ่นระเบิดสังหารบุคคล (อนุสัญญาออตตาวา) ที่กัมพูชาเป็นรัฐภาคี ซึ่งไทยได้มีหนังสือประท้วงต่อกัมพูชาไปยังญี่ปุ่นในฐานะประธานการประชุมรัฐภาคีอนุสัญญาฯ และได้ขอให้เวียนหนังสือดังกล่าวให้รัฐภาคีอนุสัญญาฯ ทราบแล้ว พร้อมทั้งมีหนังสือถึงเลขาธิการสหประชาชาติในเรื่องนี้ด้วย ในขณะที่เหตุการณ์ปะทะกันที่บ้านหนองหญ้าแก้ว ฝ่ายกัมพูชาได้เปิดฉากยิงเข้ามาในดินแดนไทย ซึ่งเป็นการละเมิดอธิปไตยและบูรณภาพแห่งดินแดนของไทย

4. ประเทศไทยเคารพและดำเนินการต่าง ๆ ตามกฎหมายระหว่างประเทศและกติกาสากล และเป็นไปด้วยความโปร่งใส โดยจัดให้คณะผู้สังเกตการณ์อาเซียน (AOT) เข้าตรวจสอบพื้นที่เกิดเหตุ นอกจากนี้ ประเทศไทยมุ่งมั่นปฏิบัติตาม Joint Declaration มาโดยตลอด เพราะเห็นว่าเป็นหมุดหมายสำคัญที่จะช่วยลดความตึงเครียดและปูทางไปสู่สันติภาพที่ทั้งสองฝ่ายมุ่งประสงค์ แต่ฝ่ายกัมพูชากลับเป็นผู้ละเมิด Joint Declaration และพยายามสร้างสถานการณ์และข้อมูลเท็จ การกระทำเช่นนี้สะท้อนถึงความไม่จริงใจของฝ่ายกัมพูชาที่จะบรรลุสันติภาพร่วมกัน

5. ประเทศไทยขอแสดงความเสียใจต่อครอบครัวผู้ที่ได้รับผลกระทบจากเหตุการณ์ทั้งสอง และขอเรียกร้องให้กัมพูชาแสดงความรับผิดชอบ ตรวจสอบเหตุการณ์ข้างต้นอย่างโปร่งใส ยุติการกระทำยั่วยุ และหันกลับสู่เส้นทางแห่งสันติภาพ เพื่อลดความตึงเครียดและมิให้เกิดความสูญเสียในอนาคต
